One Route Seems Closed, So Lawyers Try Different Lawsuit in Stock-Option Scandal
Even when it is clear that options grant dates were manipulated, it is less clear how to calculate damage to specific shareholders. And in many cases, the statute of limitations has expired. Lawyers have therefore turned to what are called derivative suits, a less popular and much less prominent kind of action in which a shareholder sues on behalf of the company and settlements usually consist of corporate governance changes and legal fees.
